Recreational marijuana bills back in 2018

Last year the New Hampshire Legislature voted to decriminalize small amounts of marijuana. This year the Legislature will consider several more bills related to the legal use of marijuana in the Granite State.

HB 1477

Prime Sponsor: Rep. Renny Cushing

This bill would allow a criminal record annulment for anyone arrested or convicted of possession of ¾ of an ounce or less of marijuana. Possession of ¾ of an ounce or less of marijuana was downgraded to a violation in New Hampshire last year.

HB 1815

Prime Sponsor: Rep. David Danielson

This bill would make it a misdemeanor to consume any marijuana in public, even if it is less than ¾ of an ounce. (There is already a separate law that prevents medical marijuana users from consuming marijuana in public.) The bill also adds a $350 fine to misdemeanor marijuana offenses. Lastly, this bill requires any marijuana to be transported in a secure container that is not in the passenger area of the vehicle.

HB 656

This bill is actually a carryover from 2017, and comes up for a vote Tuesday, January 9. The bill would legalize and tax marijuana for adults over age twenty-one.

Prime Sponsor: Rep. Skip Cleaver

This bill creates a new state agency, the Cannabis Control Commission, that would be responsible for overseeing marijuana sales in New Hampshire if it becomes legal.

SB 338

Prime Sponsor: Sen. Harold French

If marijuana becomes legal, this bill establishes where cannabis can be grown and establishes the Department of Agriculture, Markets, and Food as the licensing agency to oversee all cannabis growing operations.
