Add privacy oversight board for DHHS

Summary:

Establishes a Data Privacy and Information Technology Governance Board within the Department of Health and Human Services. The Board would be charged with overseeing data privacy risk calculation and risk mitigation efforts.

As introduced, the bill also required that all personal information collected by the Department be collected on an opt-in basis only, starting July 1, 2022. The House amended the bill and removed this opt-in requirement.

The Senate amended the bill to add the substance of two other bills:

  • SB 355, which requires third-party sellers to provide certain information to online marketplaces and to consumers, such as contact information.
  • SB 209, which amends the state laws related to payment of an employee's wages by direct deposit. In particular, this bill allows an employer to offer only electronic wage payment, such as through a payroll card.

The Senate also amended the bill to send $5 million to the Department of Health and Human Services for the housing expenses for homeless people seeking shelter.
