HB 239 (2021)

Change statute of limitations for assaults on minors

Summary:

Changes the statute of limitations for the prosecution of first degree and second degree assault offenses, to "within 6 years of the victim's eighteenth birthday."  The Senate amended the bill to change it from 6 years to 3 years.

A conference committee of representatives and senators compromised on the final bill.  The statute of limitations for first degree assault will be six years from the victim’s 18th birthday. The statute of limitations for second degree assault will be whichever is greater: six years from the date of the offense or three years from the victim’s 18th birthday.
