HB 1476 (2022)
Require person be detained after an offense while on bail, hearing before a judge
This bill did not become law.
If a person commits an offense while on bail, this bill requires that the person be detained without bail pending a hearing before a judge. The judicial hearing must happen within 36 hours, excluding weekends and holidays.
The Senate amended the bill to address only violent and other very serious offenses (e.g. possession of child sexual abuse images).
A conference committee of representatives and senators agreed to a final version of the bill that combines the intent of both the House and Senate versions. Generally speaking, if someone commits a violent or very serious offense, or if they commit another offense while out on bail, they would have to be detained and go before a judge rather than a bail commissioner.
