HB 296 (2025)
Allow building along a private road
This bill became law.
Gives a local governing body the power to issue building permits along a private road, without review and comment by the planning board, so long as the local governing body determines the private road otherwise complies with policy.
The House amended the bill, generally granting property owners the ability to build on land located along a private or class VI road.
The Senate also amended the bill, removing the Zoning Board of Adjustment's discretion for determining when to take an appeal and replacing it with a non-discretionary 30-day period.
