HB 46 (2023)
Study magistrates to replace bail commissioners
This bill did not become law.
Repeals the powers, duties, and authority of bail commissioners and instead authorizes the superior court and circuit court to appoint magistrates. Magistrates would have the power to set bail, conduct arraignment and bail hearings, issue arrest and search warrants, and so on.
The House amended the bill to instead establish a committee to study the use of court magistrates throughout the state court system to supplement or replace the current bail commissioner positions.
The Senate amended the bill to also clarify the obligations of employers using employee debit cards for payment of wages, similar to SB 46 (2023).
The Senate also amended the bill to increase the total amount of delinquent payments by an on-premises or off-premises licensee that must be reported to the Liquor Commission, similar to SB 98 (2023).
