SB 173 (2023)
Require insurers to cover emergency services in or out of network and prohibit balance billing
This bill became law.
Requires insurers to cover out-of-network emergency services in the same manner as if the services were provided by a participating provider. This bill requires the insurer to pay the out-of-network provider a negotiated rate or a rate set through a fair value independent review process. Lastly, this bill provides in state law the same protections against balance billing that exist under the federal No Surprises Act (NSA). This bill was requested by the Insurance Department.
