Study solid waste issues, consider "net public benefit" when reviewing landfill permits

Summary:

Creates two study committees related to solid waste. One committee would study prohibiting any landfill in the state from accepting waste from municipalities with no solid waste plan. The second committee would study the development of a solid waste disposal site evaluation committee. This bill also requires statutes and rules in effect at the time an application for a solid waste permit is complete to apply to the application. Lastly, this bill requires the Department of Environmental Services to consider the "net public benefit" when reviewing an application for a solid waste permit. This consideration would have to include, for example, "the incremental harms that a landfill would likely cause by identifying and determining any potentially harmful impacts on human health, property values, tourism, outdoor recreation, and wildlife."

The Senate rewrote the bill to instead add two duties to the Solid Waste Working Group. First, the group must review and make recommendations regarding municipal solid waste plans and implementing the prohibition of any landfill in the state from accepting waste from a municipality that does not have a solid waste management plan. Second, the group must review and make recommendations regarding the development of a solid waste disposal site evaluation committee or better defining alternative site analysis.
